Agency Workers Regulations (AWR) mean that agency workers should receive equal treatment compared to the end client’s own employees.
For the purposes of AWR, umbrella company employees are still classed as agency workers. For example, you should still:
Have the same terms and conditions
Get annual leave above the minimum 28 days required
Get parental time off
Get the same sick leave as the client’s own employees
Have protection against discrimination
Be allowed to use any shared facilities
Can I opt out of these?
You cannot opt out of AWR.
The Conduct of Employment Agencies and Employment Businesses Regulations 2003 also apply to agency workers. These rules aim to provide agency workers with minimum standards they can expect from recruitment agencies.
